Report on good regulatory design

Regulations help governments support economic growth, social welfare and environmental protection. The challenge is to design clear, coherent and efficient regulations and to effectively implement them, according to a report by the OECD and the Korea Development Institute, which is about facilitating good regulatory design and implementation.

The report builds on a series of expert papers that analyse the experience of Korea and other OECD members in designing and implementing regulatory oversight, stakeholder engagement, regulatory impact assessment and ex post evaluation. It identifies forthcoming challenges, possible solutions and areas for further analysis that can help governments in OECD member and partner countries improve their regulatory systems. Highlights include: regulatory oversight – a cross-institutional comparison of oversight in presidential and parliamentary systems stresses the importance of accounting for the specific context and constellation of actors; stakeholder engagement (international practices suggest four main considerations for engaging stakeholders); regulatory impact assessment, with case studies from Korea and the UK pointing to the importance of buy-in from policymakers and the business sector for making impact assessment a tool for decision making; and ex post assessment – there are two potential tensions that may emerge when organising and carrying out ex post evaluations, who evaluates and how much to evaluate.
