French law gives operator sharing power to regulator

France’s ‘La loi Macron’, an act on growth, business and equal economic opportunity, of 7 August 2015, gave ARCEP, the country’s communications regulator, a new power: the ability to request that operators amend their mobile network sharing agreements when necessary to achieve regulatory objectives. France’s highest administrative court, the Conseil Etat, has now detailed the regulator’s competence in this matter in a decision dated 9 October 2015. ARCEP will publish guidelines on mobile network sharing for consultation by the end of the year. Meanwhile ARCEP is also holding an auction to allocate spectrum in the 700 MHz band on 16 November.
