Our meeting covered presentations from BT, Ofcom and the CMA. There was an active and engaged discussion on the new Digital Markets Consumers and Competition Act which provides the CMA with enhanced powers to address the problems of the Digital Platform’s domination of the economy. The DMCCA is the UK’s equivalent to the EU’s DMA.
The CMA representative explained the next steps in the process involved designation. That will take some time but the CMA is engaged in parallel processing so that work on which entities will be subject to the new regime is underway. The regime addresses sources of market power and is intended to be more flexible than the DMA. Emphasis was placed on the fact that the issues being addressed span the globe and are being addressed by the EU Commission and the DOJ the USA. International coordination is above and on going.
In response to questions the issue of standardisation of interoperability and interconnection was discussed with the CMA recognising that internet standards will become ever more important in the future.
The additional point was made that market power creates a threat to investment and economic growth.
Mr Rosen has expertise across the full spectrum of regulatory, competition, telecommunications and compliance matters encountered by businesses operating in and around the digital, tech and media space. He has spent time in-house at one of the world’s most prominent tech companies and bring expertise, insight and a highly commercial understanding of client requirements and deliver business focused advice.
Earlier in Anthony’s career, he worked at a leading communications regulator which afforded him a valuable insight into the regulatory process as well as a solid foundation in UK and EU telco regulation. Anthony is well placed to advise on compliance, market studies, mergers, sector inquiries as well as the fast-changing regulatory landscape. Anthony also has extensive regulatory litigation experience having worked on appeals before the Competition Appeal Tribunal as well as disputes.
Mr Rosen has a keen interest in evolving international OTT and Platform regulation as regulators seek to keep pace with the constant innovation in the dynamic tech sector and the challenges of the Data economy. Anthony enjoys the constant intellectual challenge this provides, advising clients on the application of current and future laws to emerging technologies and helping them to deliver their strategic priorities.
Gerry McQuaid is the Director for Telecoms and Internet Security at Ofcom with a focus on regulating the technical aspects of security within the regimes of the Telecoms Security Act and NIS Directive. Prior to Ofcom he was a CSO within the UN system. Working for a global operator and a vendor, he was responsible for managing the various national security obligations globally. He has chaired or participated in a number of ETSI/3GPP/GSMA technical security committees and as an advisor to EuroPol and various EU bodies. Additionally, he has invested time advising various international bodies particularly on capacity building and specific vendor related oversight e.g. evaluation centres and supply chain security.

Mr Bowling is a lawyer with BT’s data legal team, specialising in data security and government investigatory powers. He has previously worked as a government litigator on cases in the Investigatory Powers Tribunal, and as a Legal Officer with the Royal Air Force advising on military cyber doctrine. He has been closely involved in the development and implementation of recent legislation in this area including the Telecommunications (Security) Act 2021, the Electronic Communications (Security Measures) Regulations 2022, Telecommunications Security Code of Practice and the Huawei Designated Vendor Direction, as well as EU legislation including the NIS 2 Directive and the Digital Operational Resilience Act. He also has an interest in digital evidence and investigation and holds an MSc in Forensic Computing.
