In the latest chapter of the long-running network neutrality saga, the United States Court of Appeals for the District of Columbia Circuit (DC Circuit) upheld most – but not all – of the Federal Communications Commission’s Restoring Internet Freedom Order, 33 FCC Rcd 311 (2018) (Order). However, the court’s decision, in Mozilla v Federal Communications Commission, No. 18-1051 (DC Circuit Oct. 1, 2019), does not resolve the regulatory uncertainty that has long hung over the US internet access market.
